Department of Labor Receives Applications for 87,298 H-2B Workers During First Day of Filing

The Department of Labor announced that 5,276 applications representing 96,400 H-2B worker positions had been received as of January 7, 2020.  Over 4,930 applications representing 87,298 workers were filed on the first day of the three day filing window alone.  It is estimated that the demand will be approximately 5-10% greater this year than last year.

While this is troublesome news, the Department of Homeland Security has the authority to release an additional 69,320 H-2B visas.  If the DHS releases all of the additional visas, it should satisfy 100% of the demand for FY2020.

As of Monday, January 6, the Department of Labor began randomly assigning applications to five groups - starting with group A.  Group A will contain applications for 35,000 H-2B workers, followed by groups B, C, and D with 20,000 each.  Group E will contain the remainder.  The DOL will begin processing applications beginning with group A.  If your company is assigned to groups C, D, or E, you will only obtain your workers through cap relief.  A portion of group B is estimated to receive their workers.
