Miss. court says dismissal of video error

JACKSON, Miss. (AP) - The Mississippi Supreme Court says a judge erred in dismissing a video that Charles N. James needed to defend himself against a lawsuit over a 2000 accident.

Rachel M. Carawan sued James in 2001 for medical bills and lost wages after she allegedly injured her back when James' vehicle backed into her car at a gasoline station.

On July 31, 2003, before trial, James produced a video of Carawan on various rides at the Six Flags amusement park in New Orleans.

The day before trial, Carawan said she would not seek damages beyond July 29, 2003, when she claimed to have recovered from her injury.

A Harrison County judge excluded the Six Flags video.

The Supreme Court on Thursday said the video was essential to James' challenge to Carawan's credibility.
