I can't figure out how the daughter was able to stay in the seat when the father came out. If the lapbar opened they both would have been dumped, not just one.

The only thing I can think of is that she when looking at the seat from the front, was sitting on the left side, where the lap bar pivots from. Should daddy had been rocking the seat, she may have been petrified anyways, and holding onto the lap bar for dear life, as well as sitting back in the seat.

Ken Martin...ceases to amaze me. I have No respect for him.

I wonder if perhaps it was intentional?

I've heard (never seen) stories of people jumping out of rides and trying to claim they were thrown out to get a lawsuit.

I'm with Hoffa, I'm trying to imagine a grown man falling out, and the child not budging? it had to be that he was rocking the seat and the little girl was scared enough to hang on tight!! it's pretty hard to fall out by just riding in the seat, even without a lapbar!

With the mentality of lawyers note in the one article how the lawyer touches on the fact that the lap bar is not supposed to open even if you are "some kid" rocking the seat. Sounds like he is trying to set up the future of his case by saying that even if his client was misbehaving he's entitled to money because he fell after violating the rules. Kinda like an oxymoron
