Targeted Action Needed for 2019 H2B Cap Relief

It is important that we remain focused on all aspects of our three-pronged strategy for H2B cap relief for 2018 and 2019:

  • 2018 strategy- Get Secretary Nielsen to release the full amount of visas she is authorized to release according to the language in the FY18 Omnibus;
  • 2019 strategy- Get cap relief language inserted into the FY19 Appropriations bills;
  • Long-term strategy- continue to drive cosponsors to HR 2004, HR 4207, and S. 792. Work with Hill Champions, House and Senate Leadership, and Trump Administration on framework of permanent fix. 
This message pertains to our efforts to get cap relief inserted into the FY19 Appropriations bills.

Committee deliberations on next year’s DHS appropriations bill is fast approaching. It is important that cap relief language is included in the baseline bill for DHS for FY19. If you recall, Chairman John Carter declined to include cap relief language in baseline DHS bill last August and we all know how this turned out.

Please email, call, and set up a meeting with your Representative or his or her District Director with the ask that your Representative make a personal request to Congressman John Carter to include the "House Skinny language" in the FY19 DHS Appropriations Bill.

Requested Language in FY2019 Legislation – Homeland Security Provision
I. Cap Relief Amendment

SEC.—Fiscal Year Cap Relief

Section 214(g)(1)(B) (8 U.S.C 1184(g)(1)(B) is amended as follows:

(C) Notwithstanding the numerical limitation set forth above, the Secretary of Homeland Security, upon receipt of DOL certifications that sufficient United States workers who are willing, qualified, and able to perform temporary nonagricultural labor are not available, shall increase the total number of visas issued under section 101(a)(15)(H)(ii)(b) of such Act (8 U.S.C. 1101(a)(15)(H)(ii)(b)) in such fiscal year above such limitation by a number sufficient to fulfill those DOL certifications; provided, that the total number of visas above the numerical limitation set forth above shall be) not more than the highest number of H–2B nonimmigrants who participated in the H–2B returning worker program in any fiscal year in which returning workers were exempt from such numerical limitation. Such increase shall be effective as if implemented at the beginning of each fiscal year.
